China's Ministry of Emergency Management issued a revised version of the "Standards for Determining Major Accident Hazards in Coal Mines" under Order No. 21 of 2026, effective July 1, 2026, replacing the 2020 version under Order No. 4.

The 2026 edition upgrades hazard control across 17 categories, adding independent clauses for monitoring, communication and open-pit slopes, while removing 13 redundant management items and introducing quantified indicators for precise enforcement, marking a shift from qualitative to quantitative control.

Industry attention has focused on the revised definition of overproduction. While the 2020 version listed six scenarios for "organizing production beyond capacity, intensity or staffing limits" as major hazards, the 2026 version lists only three, but the change does not represent a relaxation.

On conventional overproduction, the 2026 version stipulates that a mine is deemed to be overproducing if its annual raw coal output exceeds 110% of its approved (designed) capacity, or if an underground mine's quarterly raw coal output exceeds 30% of its approved capacity.

The 2020 version defined overproduction as annual raw coal output exceeding approved capacity by more than 10%, or monthly output exceeding 10% of capacity, and also included cases where a mine or its parent company issued production plans or targets exceeding approved capacity.

The 2020 version focused on annual total volume control, leaving room for short-term output surges at month-end or year-end. The 2026 version locks the annual ceiling at 110% and introduces a quarterly circuit-breaker mechanism — any single quarter exceeding 30% triggers a halt — while separately listing "organizing production in violation of personnel limits in rockburst-prone seams", achieving a shift from qualitative ambiguity to quantitative rigidity.

The introduction of quarterly assessment and stricter rules for mines with special hazards closes loopholes that allowed overproduction to be masked through monthly averaging or year-end ramp-ups, making enforcement more stringent. Mines must now organize production evenly across quarters, with any phase of high-intensity output facing direct suspension risk.

The 2026 version also makes more specific changes to mining beyond approved seams and boundaries, further detailing the former while adding exceptions for the latter.

The revised standard does not introduce new scenarios or raise thresholds, but by abolishing open-ended interpretations, it makes enforcement more exclusive and strict. Behaviors not listed will no longer automatically fall under this clause, but those listed will face undisputed top-level penalties.

Combined with new or strengthened related clauses such as "falsifying mine maps or concealing working faces", the crackdown on concealed mining beyond approved layers and boundaries has effectively intensified.

Overall, the core trend of the 2026 revision is "removing the abstract and reinforcing the concrete" and "quantitative closure", singling out high-frequency, severe disaster-causing hazards from catch-all clauses while enhancing the specificity and operability of each determination scenario.
